Important Information Regarding Colorado Senate Bill 10-011

The following is a letter sent by the Colorado Special Districts Property and Liability Pool administrators to special district members.

This is important information regarding Colorado Senate Bill 10- 011

 

Dear Member:

This letter is in response to the numerous questions the CSD Pool and CTSI have received regarding Senate Bill 011 passed by the Colorado General Assembly in the 2010 session. Because our members are oftentimes responsible for initial claim reports and claimant follow-ups along with CTSI for processing, we felt it necessary to provide a review of the legislation, which you will find HERE. It is important to note that the Colorado Division of Workers’ Compensation (WC) does not view this new statute to mean that communication between doctors and employers / insurers is prohibited; only that the doctor should make a written record if it involves something regarding the patient’s medical status. We understand that this has been a concern among employers who thought it to mean that they could not discuss anything regarding one of their employees with a doctor. This is not the case.
